Terms & Conditions

GeoPerk ("we," "our," or "us") provides a mobile application that notifies users of employee benefits and perks based on their location proximity (the "Services"). By accessing or using our Services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Services.

1. Acceptance of Terms

By creating an account, accessing, or using the GeoPerk application, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.

2. Eligibility

You must be at least 16 years old to use the Services. Certain benefits may only be available to verified members of participating organisations or employers. You are responsible for ensuring you are eligible for the benefits you access.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorised use of your account.

4. Location Services

Our Services require access to your device's location to provide proximity-based notifications. By using our Services, you consent to the use of your location data as described in our Privacy Policy. You can disable location access at any time in your device settings.

5. Subscriptions, Free Trials and Payments

Some features require a paid subscription. Subscriptions and any free trials are sold through the Apple App Store or Google Play Store and billed to your Apple ID or Google Play account.

• Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Your Apple ID or Google Play account is charged for renewal within 24 hours before the end of the current period, at the price shown at purchase.
• You can manage or cancel your subscription, or turn off auto-renewal, in your Apple ID or Google Play account settings at any time.
• If a free trial is offered, any unused portion is forfeited when you purchase a subscription. One free trial is available per user; we use device and email records to enforce this.
• Payments are non-refundable except where required by law or under the applicable app store refund policies. Refund requests are handled by Apple or Google.
• We may change subscription prices; we will give notice of changes as required, and changes will not affect your current paid period.

6. Acceptable Use

You agree not to misuse the Services, including by attempting to circumvent free-trial or eligibility limits, accessing the Services through unauthorised means, interfering with their operation, or using them for any unlawful purpose.

7. Intellectual Property

All content, features, and functionality of the Services are owned by GeoPerk and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Services without our permission.

8. Third-Party Benefits and Services

Benefits and perks shown in the App are provided by third-party partners and are subject to their own terms and availability. We are not responsible for the products, services, or offers provided by these third parties, and inclusion in the App does not imply endorsement.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the Services will be uninterrupted, error-free, or that any particular benefit will be available at any time.

10. Limitation of Liability

To the maximum extent permitted by law, GeoPerk shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services. Nothing in these Terms limits liability that cannot be excluded under applicable law.

11. Termination

You may stop using the Services and delete your account at any time from within the App. We may suspend or terminate your access if you breach these Terms or misuse the Services.

12. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will update the "Last updated" date below and, where appropriate, notify you in the App. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
